Eligible people from the 2016 MiBAC competition express their concern to Minister Alberto Bonisoli about the measures contained in the 2019 maneuver and ask for their situation to be unblocked.

The Comitato Idonei Mibac expresses concern about the scenario of uncertainty in recruitment that has been created as a result of the provisions contained in the 2019 Budget Law (L. December 30, 2018, no. 145, in G.U. 31.12.2018, no. 302 - S.O. no. 62).

In fact, Art. 1, Paragraph 339 states that "it is allowed to scroll, within the maximum expenditure limit of 3.75 million euros, for a number of positions exceeding 100 percent of the posts put up for competition, the rankingsrelated to the public selection procedures announced pursuant to Article 1, paragraphs 328 et seq. of Law No. 208 of December 28, 2015." However, Art. 1, paragraph 399 provides that “for the year 2019 [...] the Ministries [...], in relation to the ordinary hiring faculties referred to the aforementioned year, may not make recruitments of permanent staff with legal and economic effectiveness before November 15, 2019.”

It is our intention to point out that the scrolling of the rankings related to the competition for officials announced in2016is not part of the “ordinary hiring faculties” blocked until November 15, 2019, since, as stated in paragraph 339 authorizing the scrolling, “the coverage of the charges, as of the year 2019, is provided for from the resources of the fund referred to in Article 1, paragraph 365, letter b), of Law No. 232 of December 11, 2016, as refinanced pursuant to paragraph 298 of this article.” This is a fund "to be allocated for the hiring of permanent staff in addition to the hiring faculties provided for under current legislation [...], taking into account specific requests aimed at meeting undeferrable service needs of particular relevance and urgency in relation to actual needs, within the limits of staff vacancies" (Law no. 232/2016, paragraph 365).

Therefore, in the face of the serious structural shortage of staff, repeatedly complained of, it is the right of Mibac to forward to the Minister for Simplification and Public Administration a specific request aimed at coping with unavoidable service needs of particular relevance and urgency, in relation to actual needs, through the scrolling of the rankings of the competition for officials announced in 2016. The relevant recruitments are not affected by the freeze until November 15, 2019, of ordinary hiring powers, as they are covered by an ad hoc fund, already allocated and refinanced for 2019, the use of which is arranged in addition to the hiring powers provided for in current legislation.

Recall that there are now about 70 eligible candidates remaining in the ranking list, a small number from a financial point of view, all the more so considering that, according to Mibac estimates, retirements amount to about 3,000.

If, as stated on several occasions, hiring is a priority for Mibac, in light of the above we ask Minister Alberto Bonisoli to unblock the situation of the eligible before November 15, 2019, trusting in a positive acceptance of our request.
