From Oct. 11, 2021, new provisions on access to cultural, sports and recreational activities, as well as for the organization of public administrations and on the protection of personal data will come into force. In fact, the Council of Ministers approved, at the proposal of President Mario Draghi, Health Minister Roberto Speranza, Culture Minister Dario Franceschini, Economic Development Minister Giancarlo Giorgetti, Interior Minister Luciana Lamorgese, and Justice Minister Marta Cartabia, the decree-law on capitalization.

The decree stipulates that in the white zone, for performances open to the public in theaters, concert halls, movie theaters, entertainment and live music venues, and other venues or spaces, including outdoor venues,100 percent of the maximum authorizedcapacity is allowed both outdoors and indoors. Access is allowed only with green passes. In museums, the interpersonal distance of one meter has been eliminated.

Regarding participation in sports events and competitions, the permitted capacity may not exceed 75% of the maximum authorized capacity outdoors and 60% indoors. Discos and dance halls will also reopen: here, the capacity may not be more than 75 percent of the maximum authorized outdoor capacity and 50 percent indoors. Indoor venues must be guaranteed to have ventilation systems without air recirculation.

In case of violation of the rules on capacity and green passes in the areas of shows, sporting events and nightclubs, the closure applies from the second violation.

“The government’s decision to allow a return to 100 percent capacity in cinemas, theaters, concert halls, museums and all cultural venues fully embraces the proposal we have repeated and confirmed in recent weeks, including in our last hearing with the Cts,” said Minister Franceschini. “We have long been convinced of the total safety of these places with the use of the green pass and all preventive measures: from temperature control to the use of a mask. We invite Italians to return to experience culture in peace and safety.”

The decree also provides for other measures: a reorganization of the Ministry of Health aimed at strengthening the staffing of general-level directorates; in order to allow the referendum to take place, the Supreme Court may make use of 360 units within the civil service; the same rules in effect for the 2021 state bar exam are extended to 2022; and access to the premises is to be allowed only to those with green passes. To meet the special and new needs related to the emergency in Afghanistan and the reception of refugees, the Reception and Integration System is increased by 3,000 places. Finally, a number of simplifications have been introduced, consistent with the European framework, to the regulations set out in Legislative Decree 196/2003 on the processing of data for purposes of public interest. Deadlines for the expression of the Guarantor’s opinions on PNRR have been reduced to 30 days.
