Without a call for bids, it follows that the Rome Fair is “the only operator in the territory having the characteristics to perform all the services described.”

Following this decision, the Hotel Ergife appealed to the Regional Administrative Court, declaring the choice arbitrary and the procedure carried out irregular, justifying the latter with unsuitable requirements (particularly with regard to the premises and chemical toilets), incomplete documentation, and a figure set too high. The Hotel achieved initial success at the Tar, as the latter granted the request for a suspension. Formez, on the other hand, appealed to the Council of State, which recognized to its advantage the urgency of announcing the competitions.

Prosecutor Gennaro Varone is investigating the matter and has a file for bid-rigging and abuse of office with delegation of investigation to the Economic and Financial Police Unit of the Guardia di Finanza and registration against the legal representative of Formez. Hotel Ergife is therefore now awaiting the results of the investigations by the prosecutor’s office and the Court of Auditors.
